School Portrait Terms & Conditions
1. Booking & Participation
By completing the School Portrait Registration Form, you are confirming your child’s participation in the scheduled School Portrait Day.
Registration secures your child’s place for photography on the specified date. As this is a pre-booked photography event, only registered children will be photographed.
2. Package Selection & Ordering Requirement
All registered participants are required to complete their image selection and finalise their order via the online gallery within the communicated deadline.
As School Portrait Day is managed as a structured group workflow, all orders need to be completed within this timeframe to ensure smooth processing for the school as a whole.
If an order has not been finalised by the deadline, the photographer reserves the right to select the most suitable images on your behalf and proceed with the Smart Cookie package, as outlined below. The selected package will be invoiced and remains payable in full.
The Smart Cookie package includes:
1 x A4 Print, 1 x A5 Print, and 2 x Jumbo Prints – R245
Where applicable, image selection will be made with care to reflect your child naturally and appropriately.
Due to the production process, changes to image selection or package selection may not be possible after the deadline.
Full payment is required at the time of placing your order through the online gallery. Orders will only be processed once full payment has been received.
3. Proofing & Delivery
Proof galleries will be made available within 5 to 7 working days after the session and will be shared via WhatsApp.
Printed products will be delivered to the school within approximately 6 to 8 weeks after the order deadline.
Digital images will be delivered once print orders have been finalised. Please allow approximately 1 to 2 weeks after the order deadline.
4. Image Style, Artistic Discretion & Editing
All images are captured and edited in a consistent style that reflects the photographer’s artistic approach.
Final image selection and editing remain at the photographer’s discretion. Unedited or RAW images will not be provided.
School Portraits include standard professional editing. This includes basic colour correction, exposure adjustments, and minor refinements. Extensive retouching or image manipulation is not included.
5. Use of Images & Marketing Consent
In accordance with South African law, including the Protection of Personal Information Act, photographs of children are considered personal information and require parental consent for use.
Consent for the use of images is obtained during the School Portrait Registration process. By selecting the relevant option on the Registration Form, you grant permission for images of your child to be used for the following purposes:
• Portfolio use, including website and printed material
• Social media platforms
• Marketing and promotional purposes
All images will be used respectfully and in a manner that maintains the dignity and privacy of the child.
Where consent has been provided at the time of registration by a parent or legal guardian, this consent will be considered valid and binding. The photographer will not be responsible for mediating or accommodating conflicting requests from other parties, including additional parents or guardians, after consent has been given.
If you do not wish for your child’s images to be used, this must be indicated at the time of registration.
6. Privacy & Data Protection (POPIA Compliance)
All personal information collected, including names, contact details, and photographs, will be processed in accordance with the Protection of Personal Information Act.
Information is collected solely for the following purposes:
• Managing the School Portrait process
• Delivering galleries and related communication
• Processing orders
Your information will not be shared with third parties, except where necessary to fulfil your order, such as professional printing labs.
Reasonable steps are taken to ensure that all personal information is stored securely and handled responsibly.
7. Limitation of Liability
While every care is taken during the photography process, the photographer cannot be held liable for circumstances beyond reasonable control, including but not limited to:
• Uncooperative or unwilling behaviour from the child
• The child’s mood, participation, or response during the session
• Weather or environmental factors, where applicable
• Technical issues beyond reasonable control
Every reasonable effort will be made to capture a selection of natural and suitable images within the time and setting provided. However, outcomes may vary depending on each child’s comfort and cooperation on the day.
Variations in expression, participation, and engagement are a natural part of working with children and form part of the unique nature of each session. As such, these factors do not constitute grounds for cancellation, non-payment, or refund.
8. Communication & Public Feedback
The photographer is committed to providing a professional and positive experience to all clients.
Should any concerns or dissatisfaction arise, clients are encouraged to raise these directly with the photographer in writing, allowing a reasonable opportunity for resolution.
Clients are requested not to publish or share false, misleading, or defamatory statements about the photographer, business, or services across any public platform, including social media, review platforms, or online forums.
This clause does not restrict honest and fair feedback, provided it is based on factual experience and shared in a respectful manner.
The photographer reserves the right to seek appropriate legal remedy in the event of reputational harm caused by knowingly false or defamatory statements.
9. Agreement
By submitting the School Portrait Registration Form, you confirm that:
• You are the parent or legal guardian of the child
• You have the authority to provide consent
• You have read, understood, and agree to these Terms and Conditions
